Confusion over electric bike regulations

After reading two articles in BRAIN’s June 15, 2013 issue (“Speedy e-bikes trouble industry” and “NYC e-bike crackdown exposes legal morass”) as well as a follow up letter to the editor in the July 1, 2013 edition, I was compelled to respond to some apparent misunderstanding by some as to what the “laws and regulations” are with respect to electric bikes and how they do and don’t work together.
Reconsider old bicycle ordinance

Integrated bicycle facilities plans have long been key elements of both the county’s and city’s outdoor recreation plans. As they’ve been implemented, they’ve paid off big time, in terms of tourism and visitor spending! Presently, along the city’s lakefront, now collectively termed “The Harbor Center District,” there seems to be a minor void that, reportedly, is due to a city ordinance that predates the city’s more progressive approach to bike/pedestrian accommodation.

Hayward bicycle-shaped racks promote driver awareness

New bike racks along Foothill Boulevard in the shape of bicycles look whimsical, but their shape serves a serious purpose — raising driver awareness of cyclists. The hope is that the shape of the racks will alert motorists that bicyclists also are riding on the new one-way downtown traffic loop, which has no designated bike lanes, except for three blocks on Foothill from D Street north to B Street. Traffic can be heavy on the five-lane loop, and drivers often speed through the area.
